Terms of Service

By accessing or using BrainEasy (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and the operator of BrainEasy (“we”, “us”, or “our”).

You must be at least 18 years old to use BrainEasy. By using the Service, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement. We do not knowingly provide services to anyone under 18. If we discover an account belongs to someone under 18, we will terminate it immediately.

You must create an account to access most features of BrainEasy. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access to your account.

You agree to provide accurate and complete information when registering, and to keep that information up to date. You may not share your account or transfer it to another person.

BrainEasy is an AI-powered video generation platform offering two primary modes:

• Brainrot Generator — generates short-form, high-energy videos with AI narration, subtitles, and trending background footage.
• Study Helper — converts study material into concise video summaries optimised for retention.

The Service relies on third-party AI infrastructure. We do not guarantee that outputs will be free of errors, inaccuracies, or infringing material, and you are responsible for reviewing generated content before publishing it.

Access to video generation features requires credits. Credits are purchased through our platform and processed securely by Stripe. We do not store your payment card details.

All purchases are final and non-refundable. Credits are consumed upon video generation and are not returned if you are dissatisfied with the output, change your mind, or your account is terminated for breach of these Terms.

Nothing in this clause limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) where the Service is found to be faulty or not fit for the purpose for which it was supplied. In those cases, you may be entitled to a remedy in accordance with applicable law.

Certain plans are billed on a recurring monthly or annual basis. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access and any unused credits until then. We do not provide pro-rata refunds for partial periods.

You retain ownership of all content you input into the Service (e.g. text prompts, uploaded materials) and all videos generated by the Service using your inputs (“Your Content”).

By using the Service, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce Your Content solely for the purpose of operating the Service and, where you have not opted out, for marketing and promotional purposes (for example, showcasing generated videos as demo examples on our website or social media).

If you do not want your generated videos used for marketing, contact us at the address below and we will remove them promptly.

You must not use BrainEasy to:

• Generate content that is defamatory, harassing, or threatening to any person.
• Create content that infringes any third party's copyright, trademark, or other intellectual property rights.
• Produce content that is sexually explicit, depicts minors inappropriately, or promotes violence or hatred against any group.
• Generate misinformation, deepfakes, or content designed to deceive.
• Attempt to reverse-engineer, scrape, or interfere with the Service or its underlying systems.
• Resell or sublicense your account access to third parties.
• Use the Service in any way that violates applicable law.

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice.

The BrainEasy platform, brand, code, design, and all content we create (excluding Your Content) are our exclusive property or are licensed to us. Nothing in these Terms transfers ownership of our intellectual property to you. You may not reproduce, distribute, or create derivative works from our platform without our written consent.

The Service integrates with third-party providers for payment processing (Stripe), cloud storage (Cloudflare R2), and AI content generation. These providers have their own terms and privacy policies, and we are not responsible for their practices. Your use of the Service constitutes acknowledgement that such third-party services are involved in delivering it.

The Service is provided “as is” and “as available” without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

AI-generated content may contain inaccuracies, hallucinations, or copyrighted material. You are solely responsible for reviewing and verifying any content before publishing or distributing it.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, goodwill, or business opportunity.

Our total aggregate liability to you for any claim arising under these Terms will not exceed the amount you paid to us in the three months preceding the event giving rise to the claim.

You may delete your account at any time. We may suspend or terminate your account at any time if you breach these Terms, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately and any unused credits are forfeited.

We may update these Terms from time to time. When we do, we will update the effective date above and, for material changes, notify you by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
